How will the Act work for U.S. interests

  • Businesses: As of 2018, 290 U.S. companies maintained regional headquarters in Hong Kong; 434 U.S. companies had regional offices in Hong Kong.
  • Investment: As of 2017, the U.S. was Hong Kong’s 7th largest investor country, investing almost HKD325.9 billion (or USD41.8 billion) in the territory.
  • Trade: As of 2017, Hong Kong was the U.S. 19th largest trade partner and also the single-largest contributor to the U.S. trade surplus (US$32.9 billion in merchandise trade).
  • Citizens: An estimated 85,000 U.S. citizens live in Hong Kong, and a further 1.3 million visited or transited in 2018.
  • Strategic: Hong Kong is the Free World Outpost in the Indo-Pacific since the Cold War, acting as a “transformative portal” (a notion suggested by Mr. Kurt Tong, former U.S. Consul-General in Hong Kong) that demonstrates the best global practices and links China to the rest of the world.

How will the Act help Hong Kong’s autonomy

  • Annual certification: The regular checks, to be submitted by the U.S. State Department to the U.S. Congress, will help identify and address any possible threats to Hong Kong’s autonomy at the early stage before reaching severity.
  • Individual-based sanctions: By imposing sanctions including freezing the U.S.-dollar assets and denying entry to the U.S., Chinese and HKSAR government officials will face much higher costs for undermining Hong Kong’s autonomy.

How should the texts of the Act be refined

Section 7(a) of the draft Act, which limits the scope of individual-based sanctions on those persons who are responsible for Causeway Bay Books incident, Wang Jianmin/Guo Zhongxiao incident and extradition of individuals in exercise of internationally recognized human rights. The scope should be broadened so as to cover any acts or decision that erodes Hong Kong’s autonomy: “any other acts or decisions which erodes Hong Kong’s autonomy by the Government of China that are inconsistent with its commitments in the Basic Law and the Joint Declaration identified in the report under section 205 of the Hong Kong Policy Act of 1992 (22 U.S.C. 5731) to be added by this Bill, or causes further restrictions of internationally recognized human rights in Hong Kong and the exercise thereof.” [More recommendations: https://bit.ly/2NVjojY]
